Polycarbonate Lens Safety Waiver for Children’s Eyewear

  1. Purpose

This Waiver (“Waiver”) sets forth the terms under which a customer, parent, or legal guardian (the “Customer”) may elect to decline Spec Rx Direct’s professional recommendation to use polycarbonate or other impact-resistant lens materials in eyewear intended for a minor child.

  1. Professional Recommendation

Spec Rx Direct strongly recommends polycarbonate or other impact-resistant lens materials for all children’s eyewear. Polycarbonate lenses are widely regarded within the optical industry as the standard of care for minors due to their superior impact resistance and significantly reduced risk of shattering, splintering, or fracturing upon impact. The American Academy of Ophthalmology and American Optometric Association recommend impact-resistant lenses for children’s eyewear as a safety precaution against eye injury.

  1. Acknowledgment

By accepting this Waiver, the Customer acknowledges and agrees to the following:

a. The Customer has been informed by Spec Rx Direct that polycarbonate or impact-resistant lenses are the recommended lens material for children’s eyewear for safety purposes.

b. The Customer understands that selecting a non-polycarbonate or non-impact-resistant lens material may increase the risk of lens breakage, shattering, and potential eye or facial injury to the child.

c. The Customer has had the opportunity to ask questions and has received sufficient information to make an informed decision.

d. The Customer is voluntarily and knowingly declining the recommended polycarbonate or impact-resistant lens option.

  1. Assumption of Risk

The Customer voluntarily assumes all risks, known and unknown, associated with the decision to decline the recommended polycarbonate or impact-resistant lens material, including but not limited to the risk of lens breakage, injury to the eye, face, or surrounding tissue, and any consequential medical expenses or damages.

  1. Release and Indemnification

The Customer hereby releases, waives, and discharges Spec Rx Direct, its owners, officers, employees, agents, and affiliates (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any injury, harm, loss, or damage sustained as a result of the Customer’s decision to decline the recommended lens material. The Customer further agrees to indemnify and hold harmless the Released Parties from any such claims brought by the Customer or on behalf of the minor child.

  1. Parental Authority

If this Waiver is accepted in connection with eyewear for a minor child, the individual accepting this Waiver represents and warrants that they are the parent or legal guardian of the child and have full legal authority to make this decision and waive these rights on behalf of the child.

  1. Severability and Governing Law

If any provision of this Waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect. This Waiver shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles. Any dispute arising out of or related to this Waiver shall be resolved in the state or federal courts located in New York.

  1. Electronic Acceptance

By checking the acknowledgment box at checkout, the Customer confirms that they have read, understood, and voluntarily agreed to the terms of this Waiver. Electronic acceptance shall have the same legal force and effect as a handwritten signature.
