Frame Condition & Liability Waiver

  1. Purpose

This Waiver (“Waiver”) governs the submission of previously owned, used, or pre-worn frames to SpecRxDirect for the purpose of lens replacement or related optical services.

  1. Inherent Risks of Processing Used Frames

SpecRxDirect exercises professional care in the handling of all eyewear; however, the structural integrity of frames that have been previously worn or used cannot be guaranteed. Used frames may have pre-existing wear, stress, fatigue, micro-fractures, weakened solder points, or other structural compromises that are not always visible upon inspection. The lens replacement process requires the application of controlled pressure, heat, and physical manipulation to the frame, any of which may cause previously dormant weaknesses to result in visible damage.

  1. Acknowledgment

By accepting this Waiver, the Customer acknowledges and agrees to the following:

a. The Customer is submitting frames that are previously owned, used, or pre-worn.

b. The Customer understands that such frames may have pre-existing wear, fatigue, brittleness, or structural weakness that is not reasonably detectable prior to processing.

c. The Customer understands that lens removal and installation require the application of pressure and/or heat, which may result in damage to the frame, including but not limited to:
– Cracking or breakage of the frame front, bridge, or temples;
– Warping or deformation of frame components;
– Loosening, loss, or breakage of hinges, screws, nose pads, or other hardware;
– Damage to finishes, coatings, plating, or decorative elements.

d. The Customer understands that older, brittle, or heavily worn frames carry a materially higher risk of damage during processing.

e. SpecRxDirect has advised the Customer of these risks and has recommended the use of new or structurally sound frames whenever practical.

  1. Voluntary Election

The Customer, having been informed of the foregoing risks, voluntarily elects to proceed with lens replacement using their existing frames.

  1. Assumption of Risk

The Customer voluntarily and knowingly assumes all risks associated with the submission and processing of used frames, including the risk of partial or total frame damage.

  1. Release and Limitation of Liability

The Customer hereby releases, waives, and discharges SpecRxDirect, its owners, officers, employees, agents, and affiliates (collectively, the “Released Parties”) from any and all liability, claims, demands, or causes of action arising from or related to damage sustained by the Customer’s frames during handling, processing, lens removal, lens installation, adjustment, or return shipment.

  1. No Reimbursement, Repair, or Replacement

The Customer acknowledges and agrees that no refund, reimbursement, repair, replacement, or credit will be provided by SpecRxDirect for frames damaged during the lens replacement process. The Customer remains solely responsible for the cost of replacing or repairing any such frames.

  1. Shipping Risk

The Customer acknowledges that shipping of frames to and from SpecRxDirect is undertaken at the Customer’s risk, and SpecRxDirect is not responsible for damage occurring in transit. Package Protection, when available at checkout, is offered as an optional safeguard against shipping-related loss or damage.

  1. Severability and Governing Law

If any provision of this Waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect. This Waiver shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles. Any dispute arising out of or related to this Waiver shall be resolved in the state or federal courts located in New York.

  1. Electronic Acceptance

By checking the acknowledgment box at checkout, the Customer confirms that they have read, understood, and voluntarily agreed to the terms of this Waiver. Electronic acceptance shall have the same legal force and effect as a handwritten signature.
