Lens Recommendation & Frame Damage Liability Waiver

- Purpose
This Waiver (“Waiver”) governs circumstances in which a customer (“Customer”) elects to decline Spec Rx Direct’s professional recommendation regarding lens type, material, thickness, or design best suited for the Customer’s frames, prescription, or intended use.
- Professional Recommendation
Spec Rx Direct provides lens recommendations based on industry best practices and the specific characteristics of the Customer’s frames and prescription. Recommended lens options are selected to ensure proper fit, structural compatibility, optical performance, and the long-term durability of both the lenses and the frames. Declining these recommendations may result in suboptimal fit, diminished visual performance, or physical damage to the eyewear during fabrication or use.
- Acknowledgment
By accepting this Waiver, the Customer acknowledges and agrees to the following:
a. The Customer has received and reviewed the lens recommendations provided by Spec Rx Direct.
b. The Customer has had the opportunity to request clarification and has been given sufficient information to make an informed decision.
c. The Customer is voluntarily and knowingly declining one or more of the recommended lens options.
d. The Customer understands that the selected lens configuration may not be optimal for the frames or prescription provided, and that this selection is being made against the professional recommendation of Spec Rx Direct.
- Assumption of Risk
The Customer voluntarily assumes all risks associated with declining the recommended lens option(s), including but not limited to:
a. Physical damage to the frames during lens removal, fabrication, fitting, or installation, including cracking, chipping, warping, or breakage;
b. Premature wear or failure of the frames during normal use;
c. Reduced optical performance, visual discomfort, or lens distortion;
d. Any additional costs associated with repair, remake, or replacement of the affected eyewear.
- Release and Limitation of Liability
The Customer hereby releases, waives, and discharges Spec Rx Direct, its owners, officers, employees, agents, and affiliates (collectively, the “Released Parties”) from any and all liability for damage to the Customer’s frames, lenses, or eyewear resulting from the Customer’s decision to decline the recommended lens option(s). No refund, replacement, repair, or credit will be issued for damage or dissatisfaction arising from this decision.
- No Warranty
Frames fitted with non-recommended lens options are not eligible for Spec Rx Direct’s standard workmanship guarantee or warranty coverage with respect to any issue reasonably attributable to the declined recommendation.
- Severability and Governing Law
If any provision of this Waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect. This Waiver shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles. Any dispute arising out of or related to this Waiver shall be resolved in the state or federal courts located in New York.
- Electronic Acceptance
By checking the acknowledgment box at checkout, the Customer confirms that they have read, understood, and voluntarily agreed to the terms of this Waiver. Electronic acceptance shall have the same legal force and effect as a handwritten signature.
